1. Agreement
These terms are an agreement between you and TabulaSMS. By texting one of our services, using this website or signing an order with us, you agree to them, together with our SMS terms, acceptable use policy and privacy policy. If you do not agree, do not use our services.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, and be the subscriber or authorized user of the mobile number you use with us. If you use our services for an organization, you confirm that you are authorized to accept these terms for it.
3. Our services
TabulaSMS offers ready-made services, including SMSPilot, AnnounceMe, MVC Watch, Remote Start, WhatsApp Bridge and Texting, and builds custom SMS solutions. Some services are offered in beta or by invitation, and a service’s page describes what it does and how to access it. Beta services are provided to test and improve them, and may change or end.
Our services pass information between you and other systems. Flight results come from airlines and booking sites, appointment openings from government scheduling systems, and vehicle commands go through your vehicle’s connected service. We do not control those systems and do not guarantee their availability, prices or accuracy.
4. Text messaging
Message and data rates may apply, according to your mobile plan. Message frequency varies by service and by how you use it. Reply STOP to any message to stop that service and HELP for help. Carriers are not liable for delayed or undelivered messages. The full terms for each messaging program are in our SMS terms.
5. Your responsibilities
- Keep your phone and the number you use with us secure. Commands sent from your number are treated as coming from you.
- Give accurate information, and update it if it changes.
- Follow our acceptable use policy, including the rule that you only add people to a service such as AnnounceMe with their consent.
- Check important details, such as a fare, an appointment or the state of your vehicle, before relying on them.
6. Custom solutions
When we build a custom solution for an organization, a separate written agreement or order sets out the scope, fees and responsibilities. That agreement controls if it conflicts with these terms. The organization is responsible for the content it sends, for obtaining and recording recipient consent, and for its campaign information in carrier registration.
7. Third-party services
Some services act on third-party accounts or systems at your request, such as a vehicle manufacturer’s connected service or a public scheduling site. Your use of those systems is also governed by their own terms, and you are responsible for having the right to use them. A booking made through one of our services is between you and the airline, agency or provider concerned.
8. Intellectual property
The services, this website and the TabulaSMS, SMSPilot and AnnounceMe names and logos belong to TabulaSMS. We grant you a limited, personal, non-transferable right to use the services as these terms allow. You keep ownership of the content you send, and you give us permission to process it only to provide the services.
Other names, such as WhatsApp, belong to their owners. Their use on this site identifies compatibility and does not mean endorsement.
9. Availability
We work to keep our services running at all times, and current status is shown on our service status page. Services may be interrupted for maintenance, by carriers or providers, or for reasons outside our control, and we may change or retire a service. Where a change materially reduces a service you rely on, we will try to tell you in advance.
10. Disclaimers
Except where the law does not allow it, the services are provided “as is” and “as available”, without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that a service will find a particular fare or appointment, deliver every message, or complete every command.
11. Limitation of liability
To the extent the law allows, TabulaSMS is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunities. Our total liability for any claim relating to the services is limited to the greater of the amount you paid us for the service in the twelve months before the claim, or one hundred US dollars. Some jurisdictions do not allow these limits, so they may not apply to you.
12. Indemnity
If you use our services to send messages to others, you agree to defend and indemnify TabulaSMS against claims arising from the messages you send, a lack of recipient consent, or your breach of these terms.
13. Ending the agreement
You may stop using a service at any time by replying STOP or by emailing support@tabulasms.com. We may suspend or end your access if you break these terms, if your use puts other users or our carrier registrations at risk, or if we stop offering a service. Sections that by their nature should survive, including 8, 10, 11, 12 and 14, continue after the agreement ends.
14. Governing law
These terms are governed by the laws of the State of New Jersey and the United States, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.
15. Changes and contact
We may update these terms. The current version is always on this page with its effective date, and material changes take effect 30 days after we post them. Continuing to use a service after that means you accept the change.
